Demand notice seeking complete ban on kath in police stations

 

Subject: Demand Notice seeking a complete ban against use of “Kath” against under-trials in Police Stations in the State of Punjab:

Dear Sir,

I have been supplied a video of some under-trial persons lying in a “Kath” (fetters) in Police Station City-1, Moga. About half a dozen persons are seen in this video, with their feet duly shackled in a wooden structure , called ‘Kath.” The wooden structure is seen to be locked. The video is of 25th March, 2021, made at about 12.06 Noon. The concerned persons were arrested on 25th March, at around 9.00 PM, and released on 26th March, 2021 at 3.00 PM. The persons , with their legs/feet fixed in the ‘Kath” (fetters) are either sitting or lying on the floor. Such persons can not go even for urination, without lock of ‘Kath” being opened. Some time, the call of nature is so strong (and the lock can not be opened well within time), that such persons have to urinate in their trousers also. The sight of such persons in “Kath”(fetters) is disgusting. It is inhumane, and humiliating. It is violative of fundamental right to life and dignity of the accused persons. Such treatment cannot be justified atleast in a Country governed by rule of law. Notwithstanding its undesirability, this system is being use in many Police stations. This practice needs be abolished with immediate effect. A link of the related video is stated hereunder:-

I also demand strict action against the Incharge of City-1 Police Station, Moga for undermining the fundamental right of under-trials, to their dignity and honour. In case the needful is not done immediately, in that event, I shall be left with no other alternative except to approach the Hon’ble High Court for seeking redressal of my legitimate grievance, mentioned above, in public interest.
